Does California recognize common-law marriage?

Relationships often grow over time without a formal wedding. In some states, couples who live together for years can be considered legally married under “common-law marriage.” 

No common-law marriage in California

The state does not recognize common-law marriage. No matter how long a couple lives together or shares responsibilities, they do not gain the same legal rights as a married couple unless they have gone through a valid marriage ceremony and obtained a marriage license. This has been the law in the state since 1895.

Recognition from other states

Although the state does not allow couples to form a common-law marriage within the state, it will recognize a valid common-law marriage created in another state. This means if a couple met the requirements for common-law marriage in a state that allows it, California will honor that status when they move here.

Legal protections for unmarried couples

While living together in California does not create a marriage, unmarried couples may still have legal options. For example, they can create cohabitation agreements to outline property rights, financial arrangements, and other terms. Without such agreements, dividing shared property or handling other disputes can be more challenging if the relationship ends.
