What tax rules apply to alimony and child support?

Family law often intersects with tax laws, especially during divorce proceedings. Understanding the tax implications of alimony and child support payments can help individuals plan better during and after a divorce.

Alimony and its tax treatment

Alimony payments, sometimes called spousal support, are financial payments one spouse makes to the other after a divorce. Tax laws regarding alimony have changed significantly in recent years. For divorce agreements finalized after December 31, 2018, the person paying alimony cannot deduct these payments on their federal tax return. Similarly, the recipient of alimony does not report it as taxable income. However, for agreements finalized before this date, the previous rules apply unless both parties agree to update the agreement to align with current laws.

Child support and taxes

Child support payments, unlike alimony, are not taxable or tax-deductible. The parent making child support payments cannot claim them as a deduction on their tax return. Similarly, the parent receiving child support does not include these payments as taxable income. This ensures that child support funds remain fully available for the child’s needs without added tax burdens on either parent.

Tax implications for claiming dependents

Tax laws allow one parent to claim the child as a dependent, which can result in valuable tax benefits. Generally, the custodial parent—the one the child lives with most of the time—is entitled to claim the dependent exemption. However, noncustodial parents may claim this benefit if the custodial parent provides a signed release (IRS Form 8332) granting them the right to do so.
